Metro App Privacy Policy Notice

Introduction

The Los Angeles County Metropolitan Transportation Authority (“LA Metro” “Metro” “us” “we” “our”) is committed to protecting your privacy. This Privacy Notice explains what LA Metro collects, uses, shares, and safeguards your information when you interact with LA Metro Mobile Application (“LA Metro App”).  

BY ACCESSING OR USING LA METRO APP, YOU CONSENT TO THE COLLECTION, USE, AND SHARING OF YOUR INFORMATION AS SET FORTH IN THIS PRIVACY NOTICE. Please read this Privacy Notice carefully before using LA METRO APP or submitting personal information to us.

This Privacy Notice applies to the LA Metro App and related services.

By accessing or using the LA Metro App, you consent to LA Metro’s collection, use, and sharing of information as described in this Privacy Notice, solely for purposes related to the operation, administration, and delivery of Metro services.

Metro does not sell personal information and does not use personal information for commercial advertising purposes. Metro may share personal information only as described in this Privacy Notice, including where disclosure is required by law, authorized by you, or necessary for Metro or its service providers to perform functions on Metro’s behalf in connection with delivering Metro services.

We reserve the right to update this Privacy Notice at any time to reflect changes in the LA Metro App, legal compliance, or operational needs. If we make material changes to this Privacy Notice, we will provide notice through Metro channels, including metro.net and the LA Metro App, and, where appropriate, other Metro websites or digital services and channels.

Updates will be effective when the revised Privacy Notice is posted and will apply to your use of Metro services after the effective date listed above. Your continued use of Metro services after that date means the updated Privacy Notice applies.

LA Metro will handle your information in accordance with the Privacy Notice in effect at the time your information is collected, unless you authorize otherwise or applicable law permits or requires a different approach.

Information We Collect and Use

We collect information when LA Metro App is installed on your device. LA Metro App will also passively or automatically collect information from your device. We use this information to operate LA Metro App, provide the services, carry out our business, comply with laws, and for other purposes described in this Privacy Notice.

Information collected from LA Metro App installation

When LA Metro App is installed on your mobile device, Metro will set up a user profile associated with that mobile device and create a User ID for you. This is a unique identifier generated by us in accordance with this which is necessary in order for us to provide you with our services. After installation of LA Metro App, we will collect and use the User ID, together with certain other information including Metro area and certain device information which may include your device ID or other unique identifier, unique device token, device type, operating system version and settings, as well as your device screen resolution and keyboard language, all in accordance with this Privacy Notice. We may link this information with the user profile for your mobile device.

Location Data

We may collect location information (such as your device geolocation, routes, and travel information) to provide features like trip planning, nearby service information, disruption alerts, and event-related rider guidance. Where available, you can choose whether to allow location access “While Using the App” or “Always,” and you can change your choice at any time in your device settings.

Background (Always) location access is optional. If you enable it, the LA Metro App may collect location information in the background to support features you request (for example, proactive service alerts for a saved commute). This data may be collected in the background even when you are not using the app, in order to personalize the services and provide you with location-based alerts.

If you do not enable background location, you can still use core features, but some location-based features may be limited.

You can control location data collection by (1) adjusting your device location permissions within the LA Metro App’s privacy settings screen, or (2) turning location services off at the device level.

Your Choices Regarding Your Personal Information

You may choose what information you provide when using Metro services, including in submitting feedback, surveys, or service requests, or contacting customer service. In some cases, certain information is necessary to operate specific programs, features, or functions. If you choose not to provide required information, you may not be able to access or use those services or features.

Metro uses information only as needed to operate and deliver public transportation services and to meet legal and operational requirements.

Metro Use of Tracking Technologies

Metro services may use tracking and similar technologies to support core functionality, security, analytics, and service improvement. Metro may use them to enable application functionality and features, remember user preferences, maintain sessions, and understand how services are used to improve accessibility, reliability, and performance, and diagnose technical issues and maintain system integrity. They do not typically contain information that directly identifies you unless you choose to provide such information through a Metro service.

How We Use Your Information

LA Metro directly, and through its LA Metro App vendors or service providers, uses information only for purposes related to the operation, administration, and delivery of public transportation services. We collect and use information in a manner that is reasonably necessary to provide services to riders, support Metro operations, and meet legal and regulatory obligations.

Depending on the services you use, LA Metro may use information to:

  • Provide transit information, trip planning, and service updates
  • Deliver customer communications including information about features, promotions, sweepstakes, studies, surveys, news, updates and events, and responses to inquiries or service requests
  • Support customer service, dispute resolution, and account assistance
  • Improve the reliability, accessibility, and performance of Metro services
  • Maintain the security and integrity of Metro systems and infrastructure
  • Conduct analytics, research, and service planning using aggregated information
  • Comply with applicable laws, regulations, and public safety requirements

Third Party Vendors

For function of the LA Metro App, we may need to share this information with a member of our  vendors or service providers with your consent or as you direct; to manage LA Metro App and provide services; for cloud storage hosting, database and server co-location services, data and cyber security services, fraud detection and prevention services, LA Metro App analytics tools including session replay records for usability and functionality monitoring and analysis, services for measuring attribution and the efficacy of our publication and marketing efforts, sending notices and communications, e-mail distribution and monitoring services, and our business, legal and financial advisors. These service providers may receive or otherwise have access to our users’ information, depending on each of their particular roles and purposes in facilitating and enhancing our services and business, and may only use it for such purposes.

Statistical Data

To monitor utilization of LA Metro App and improve its quality, we may compile statistical information through analytics services. This might include collecting and analyzing the number of visitors to the LA Metro App, patterns of traffic flowing through LA Metro App, and information regarding your clicks, and your referral URL to reflect data collected in LA Metro App. The analytics services may transfer this information to third parties in case of a legal obligation or if a third-party processes data on behalf of that service. We may use this information to generate aggregate statistics about visitors to our LA Metro App. Please check your web browser if you want to learn what information your browser sends or how to change your settings.

Other Usage Data

LA Metro App will also collect information when you access and use LA Metro App and services such as, your public transit historical searches on the services, your saved routes and most used stations as well as you your in-app settings. We will use this to provide the services, enhance your experience, and personalize the services we provide to you.

Geolocation Data

We will collect location information such as your geolocation, route, and travel information to provide you with services. When you use LA Metro App, we collect detailed location, including GPS signals and other device sensor data such as gyro/oscilloscope, sent by your mobile device on which the service is installed and activated. This enables us to provide you with the service and to create a detailed location history of your public transit trips.

PLEASE NOTE THAT WE COLLECT YOUR LOCATION DATA IN THE BACKGROUND EVEN WHEN YOU ARE NOT USING THE LA METRO APP TO PERSONALIZE THE SERVICES AND MAXIMIZE YOUR USER EXPERIENCE AND TO DEVELOP AND ENHANCE OUR PUBLIC TRANSIT INFORMATION SERVICES. YOU MAY CHOOSE TO DISABLE AND OPT-OUT FROM THIS BACKGROUND COLLECTION OF DATA UNDER THE LA METRO APP’S PRIVACY SETTINGS SCREEN.

How Long We Keep Your Information

LA Metro retains personal information only for as long as it is reasonably necessary to operate and support Metro services, maintain accounts where applicable, and meet legal, regulatory, and public safety requirements.

Communications and Notifications

Metro may communicate with you through available channels, including in-app push notifications, in-app notices, or other contact methods associated with your use of Metro services. You may manage certain notification preferences through your device or application settings.

Safeguarding of Information

LA Metro uses reasonable administrative, technical, and physical safeguards required by law for a public agency to protect personal information from unauthorized access, use, or disclosure.

These safeguards may include access controls, security monitoring, encryption where appropriate, vendor security requirements, and procedures designed to protect the confidentiality and integrity of information. Metro reviews and updates its security practices as needed to address evolving risks and operational requirements.

While Metro takes steps to protect personal information, no system can be guaranteed to be completely secure. Information is handled in accordance with applicable laws, regulations, and Metro’s information security and record retention policies.

Requests to Delete Personal Information

The LA Metro App does not collect personal information. If you make a request to LA Metro to delete any of your information, LA Metro will handle such request in compliance with applicable law. The only information retained is an anonymized device ID and prior geolocation data.

Links to External Websites

Metro websites and applications may include links to external websites or services for your convenience, including services operated by Metro contractors, partner agencies, or other public or private entities.

When you follow a link to an external site, you are leaving Metro’s digital environment and are subject to the privacy policies and practices of that site. Metro does not control and is not responsible for the content, privacy practices, or security of external websites.

Metro provides links to external resources as a public service and does not share your personal information with those sites unless explicitly stated and authorized.

Legal, Public Safety, and Regulatory Disclosures

Metro may disclose personal information when required by law, court order, subpoena, or other lawful process, or when necessary to protect public safety, Metro systems, or the rights and safety of Metro, riders, employees, or the public.

Aggregated and De-Identified Information

Metro may use and share aggregated or de-identified information for planning, research, reporting, and service improvement purposes. This information does not identify individual riders.

Information on Children

LA Metro App is not directed to children as the products and services on the LA Metro App are intended for persons 13 years of age and older. We do not knowingly collect, use or disclose any personal information from children. If we learn that personal information of persons less than 13 years-of-age has been collected through our LA Metro App, we will take the appropriate steps.

Governing Law and Jurisdiction

This Privacy Notice is governed by the laws of the State of California, without regard to its conflict of laws principles. Any claims arising out of or relating to this Privacy Notice shall be subject to the jurisdiction of the state and federal courts located within the State of California, as applicable to a public agency.

If any provision of this Privacy Notice is determined to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
