Introduction
"Where Does Metro Take You?" (the "Contest") is Metro's way of finding out how you get around Los Angeles County. Metro wants to know how, why and where you ride, how transit helps and why you think others should use public transit. If you have found ways to get there faster, increase your enjoyment and feel good about it while doing it, Metro wants to know. The Contest is intended to reward and give recognition to those individuals, (the "Contestants") for providing information, encouragement and advice on riding Metro. The goal of the Contest is to motivate Metro users to create innovative, fun and inspiring itineraries to encourage greater public use of Metro bus and rail services.
1. Eligibility: "Where Does Metro Take You?" (the "Contest") is open only to legal residents of Los Angeles County who are at least eighteen (18) years old at the time of entry. Employees of the Los Angeles County Metropolitan Transportation Authority ("Metro"), contractors, judges, or any individual involved with the design, production, execution, or distribution of the Contest and their immediate family (spouse, domestic partner, parents and step-parents, siblings and step-siblings, and children and step-children) and household members (people who share the same residence at least three (3) months out the year) are not eligible. This Contest is void wherever prohibited by law and is subject to all applicable federal, state, local and municipal laws and regulations. Participation constitutes Contestant's full and unconditional agreement to these Official Rules and Metro's decisions, which are final and binding in all matters related to the Contest. Eligibility for a prize award is contingent upon fulfilling all requirements set forth in these official rules.
2. Sponsor of the Contest: The Sponsor of the Contest is the Los Angeles County Metropolitan Transportation Authority ("Metro"), One Gateway Plaza, MS 99-19-7, Los Angeles, California 90012. Metro makes all decisions related to the development, management and implementation of the Contest.
3. How To Enter: Complete the official Where Does Metro Take You? Entry Form found at www.metro.net/ride. Entries can be submitted starting at 9:00 a.m. PST on February 1, 2011 and will be accepted until 5:00 p.m. PST on June 30, 2011. After you complete your entry form you will receive an email confirming your entry by Metro staff within five (5) business days. Contestants can submit as many entries as they like and each entry is eligible for a prize according to these rules. Entries must comply with the Conditions of Participation listed below.
4. Winner Selection: Users will have the ability to rate Contestants' entries. Finalists will be named First, Second and Third Prize winners in an order according to the most popular ratings received. All finalists will be notified by email and/or phone one week before the award date. The finalists will be required to sign and return to Metro within three (3) days of the date notice is sent, an Affidavit of Eligibility and Liability/Publicity Release (except where prohibited) in order to claim his/her prize. If a finalist of any prize cannot be contacted, fails to sign and return the Affidavit of Eligibility and Liability/Publicity Release within the required time period, or if notification is returned as undeliverable, the finalist forfeits the award. In the event that a finalist of a Contest award is disqualified for any reason, Metro may award the applicable prize to an alternate winner selected by the panel. All contestants selected as final winners are not eligible to win again. Winning entries will be featured on www.metro.net/ride.
5. Judging Criteria: In the event of a tie, entries will be reviewed by a panel of judges selected by Metro. Entries will be judged on how useful they are to other riders, in terms of serving as a guide to riding the Metro system. Decision of the judging panel is final. Metro will select winning entries based on:
- Originality
- Creativity
- Utility
- Persuasiveness
- Fun
6. Prizes: First prize is one (1) Metro 5-Day Pass. Second Prize and Third Prize is a Travel Kit which includes a Metro canvas bag, Go Metro 2011 calendar, Metro t-shirt, Riders Guide, System Map and Go Metro Destinations Guide. LIMIT OF ONE PRIZE PER PERSON/FAMILY/HOUSEHOLD.
7. Entry Conditions and Release: By entering, each Contestant agrees to: (a) comply with and be bound by these Official Rules and the decisions of Metro which are binding and final in all matters relating to this Contest; (b) release and hold harmless Metro and all of its past and present officers, directors, employees, agents and representatives (collectively, the "Released Parties") from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a Contestant's entry, creation of an entry or submission of an entry, participation in the Contest, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, transmission, performance, exploitation or use of entry; and (c) indemnify, defend and hold harmless Metro from and against any and all claims, expenses, and liabilities (including reasonable attorneys' fees) arising out of or relating to a Contestant's participation in the Contest and/or Contestant's acceptance, use or misuse of prize.
Additional Conditions: Metro reserves the exclusive right to interpret all conditions relating to this Contest. Metro reserves the right to extend or terminate the Contest at any time. Metro reserves the right in its sole discretion to disqualify any individual that Metro either finds to be (1) acting in violation of these Official Rules; (2) acting in an unsportsmanlike or disruptive manner; (3) acting with the intent to threaten, annoy, abuse or harass any person or to disparage any goods or services of Metro or to erode the goodwill of Metro; or (4) exhibiting conduct that Metro finds inappropriate, immoral, or otherwise objectionable. Submissions containing any matter which in the sole discretion of Metro is indecent, defamatory, in obvious bad taste, which demonstrates a lack of respect for public morals or conduct, which contains information that is inconsistent with the mission of Metro or which adversely affects the reputation of Metro will not be accepted. If any text of a Submission is in a language other than English, the Submission must be accompanied by an English translation of that text. Each Contestant represents and warrants that he or she is the sole author and owner of the Submission, that the Submission is wholly original with the Contestant, that it does not infringe any copyright or any other rights of any third party of which Contestant is aware. Metro assumes no responsibility for lost, late, misdirected, or illegible entries or for any computer, online or technical failures or malfunctions. Entries will be considered made by the authorized account holder of the email address submitted at the time of entry.
8. General Conditions: Metro reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Metro's control impairs the integrity or proper functioning of the Contest, as determined by Metro in its sole discretion. Metro reserves the right in its sole discretion to disqualify any individual or Contestant it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal or civil law, and, should such an attempt be made, Metro reserves the right to seek damages from any such person to the fullest extent permitted by law. Metro's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
9. Publicity: Except where prohibited, participation in the Contest constitutes winners' consent to Metro and its agents' use of the winner's name, likeness, photograph, voice, opinions, and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
10. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Contestants, printing errors or by any of the equipment or programming associated with or used in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damages to persons or property which may be caused, directly or indirectly, in whole or in part, from Contestant's participation in the Contest or receipt or use or misuse of any prize. If for any reason a Contestant's entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, Contestant's sole remedy is another entry in the Contest. No more than the stated number of prizes will be awarded.
11. Disputes: Contestant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded shall be resolved individually, without resort to any form of class action; (2) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved exclusively in an appropriate judicial or administrative forum of the State of California; and (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees. All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules, or the rights and obligations of the Contestant and Metro in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules, which would cause the application of laws of any jurisdiction other than the State of California
12. Privacy: Should a Contestant choose to provide Metro with personal information by registering or filling out the entry form through Metro's website, that information is used to respond to Contestants in matters regarding their submissions and/or the Contest only—unless the Contestant chooses to receive updates or notifications about other competitions from Metro on an opt-in basis. Information is not collected for commercial marketing.
13. Official Rules Request/Winners List: To request the Official Rules, send a self-addressed, stamped envelope by June 1, 2011 to: "Where Does Metro Take You?" Official Rules, One Gateway Plaza, MS 99-19-2, Los Angeles, CA 90012. Official rules are also posted online at www.metro.net/ride. February winning entries will be announced on March 18, 2011 at 9:00 a.m. PDT. March winning entries will be announced on April 22, 2011 at 9:00 a.m. PDT. April winning entries will be announced on May 20, 2011 at 9:00 a.m. PDT. May winning entries will be announced on June 17, 2011 at 9:00 a.m. PDT. June winning entries will be announced on July 22, 2011 at 9:00 a.m. PDT.
